1. Account Creation

1. By creating an account you hereby agree that you are aged 13 or higher. No one under the age of 13 may create an account. Creating an account while you are under the age of 13 may result in account removal.
2. Usernames must be kept free of any inappropriate words, slang, or slurs.
3. Display Names must be kept free of any inappropriate words, slang, or slurs.
4. Profile Pictures, during account creation you are allowed to upload a profile picture, please keep profile pictures free from any NSFW(Defined further down) content.

5. Mature Accounts

1. Accounts may have the option if they are over 18 to set their account to mature only if the accounts uploaded content is mainly NSFW.

3. Account Deletion

1. To delete your account you must login and navigate to https://gryphin.art/dashboard/?block=delete.

4. Account Data

1. By creating your account you agree that Gryphin may store your data within the United States.
2. You may request a copy of your data. Details are in the Privacy Policy.

5. Punitive Actions

1. Gryphin reserves the right to remove any account that it may see fit for the well-being and safety of the community.
2. Gryphin reserves the right to remove any account that it may see fit that breaks the guidelines and values of the site.

6. Content

1. IRL Images may be uploaded, scenery, cosplay, hand made works.
2. NSFW Content is allowed on The Site.
3. Upload only content that is yours, or that you have permission to upload.
4. Content must be labeled appropriately, you may direct questions to staff if you need assistance before uploading.

1. SFW

1. Not depicting a character in any sexual or suggestive poses or situations, example: Fully Clothed Characters, or unclothed but does not display any sexual parts of the body.

2. Suggestive

1. Depicts a character in seductive positions, or scenarios. Could include swimsuits, lingerie, Undergarments. But does not display sexual organs.

3. NSFW

1. Depicts a Character in sexual situations, and fully naked, in positions that display in a sexual nature.

4. ABSOLUTELY NO UNDERAGED CHARACTERS IN SUGGESTIVE OR MATURE SITUATIONS
5. NO IRL PORNAGRAPHIC IMAGES

5. Our Rights to Content

1. You grant us the ability to host, display, and take screenshots of your content. This is for the purpose of us to host the content and to debug issues that may arise with the content
2. We hold a “use exclusivity” to the content that is uploaded while on our system. You retain ownership of the content, this allows us to host and display your content, take development screenshots, and use of debugging.

7. GDPR

1. We honor these from their respective areas. You are able to request the data we have stored for your account in your account settings under Request Data. For more information send an email to [email protected]

8. CCPA

1. Any complaint with us is not satisfactorily resolved, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834 or by telephone at (800) 952-5210 or (916) 445-1254.

9. Limitation of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE LESSER OF THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING OR $5,000.00 USD. CERTAIN US STATE LAWS AND INTERNATIONAL LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.

10. Prohibited Activities

1. Systematically retrieving data or content from The Site to create a collection or database without written permission from you.
2. Trick, defraud, or mislead you or other users, especially in any attempt to learn sensitive account information such as user passwords.
3. Circumvent, disable, or otherwise interfere with security-related features of The Site. This includes features that prevent/restrict the use of any content limits site usage.
4. Harass, abuse, or harm another person using any information obtained from the site.
5. Use the support services improperly, or submit false reports of abuse or misconduct.
6. Use the site inconsistently with any applicable laws or regulations.
7. Attempt to upload or transmit viruses, Trojan horses, or other materials (including excessive use of capital letters and spamming) that interferes with any party's uninterrupted use of your Site and its features.
8. Use scripts, data-mining, robots, or similar data gathering tools to send comments or messages.
9. Delete the copyright or other proprietary rights notice from any content.
10. Impersonate another user or person or use the username of another user.
11. Upload any materials that actively or passively collects information or acts as a transmission mechanism (includes gifs, 1x1 pixels, web bugs, cookies, spyware, pcms, etc.)
12. Interfere, disrupt, or create an undue burden on The Site, networks, or services.
13. Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of The Site to you.
14. Bypass measures of The Site designed to prevent/restrict access.
15. Copy/adapt The Site's software (includes Flash, PHP, HTML, JavaScript, or other code).
16. Decipher, decompile, disassemble, or reverse engineer any of the software that makes up The Site.
17. Use any automated system (spiders, robots, cheat utility, scraper, offline reader) to access the site, or launch any unauthorized script or software (Unless as a result of a standard search engine or internet browser usage).
18. Use the site in an unauthorized way (collecting usernames, email addresses, of users for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses).

11. Sales/Services

1. Sales and/or Services that are rendered through Gryphin between users are between the users. Gryphin holds no responsibility or liability on transactions made between users.

12. Pro

1. Pro memberships are an elective item that allow you to support the site. This comes with a 15 day return policy per cycle.

13. Cookies

1. Gryphin utilizes cookies for Login, and dark mode and special effects

14. Updates

1. Gryphin reserves the right to update these terms at any time with notice upon completion. Updates will take effect 7 days after implementation.

     15. AI Generated Images

1. Gryphin has a strict zero tolerance policy on AI generated content.
2. Users caught posting AI generated images will receive a permanent ban and will not be able to appeal their ban.
3. Repeat violators that ban evade and post AI generated images may be reported to the proper authorities as this is content theft and is punishable by law.
